What is Duty Drawback?

Drawback is the refund of certain duties, internal revenue taxes, and certain fees collected upon importing goods. Such refunds are only allowed upon the exportation or destruction of goods under U.S. Customs and Border Protection supervision. Duty Drawback is an incentive scheme that allows importers, exporters, and manufacturers the opportunity to recover customs duties in the United States.

Tariff Engineering 

  • Strategic design, manufacturing, or alteration of a product to ensure it falls under a lower tariff classification, thereby reducing import duties

First Sale - Customs Value based on first price paid

  • US importers are allowed to base the customs value on the first price paid in a series of transactions as opposed to the last sale price before the goods enter the U.S.
  • Multiple sales of the goods before the goods reach the US
  • Earlier sale must be a bona fide sale for export to the United States

Duty Drawback

  • U.S. Customs refund of duties and fees previously paid on imported goods at time of customs entry
  • This refund is available when the imported goods are subsequently exported or destroyed 
  • Claims must be filed within 5 years from the date of importation of the good
  • The goods must be exported or destroyed within 5 years from the date of importation
